PT. BINAWAN INTI UTAMA (hereinafter referred to as “We”, “Us”, or “BIU”) is committed to collecting, using, storing, disclosing, protecting, and processing the information and/or personal data of users (hereinafter referred to as “You” or the “Personal Data Subject”) in accordance with Law Number 27 of 2022 concerning Personal Data Protection and other applicable laws and regulations.

This Privacy Policy explains how We collect, use, store, disclose, protect, and process Your information and/or personal data. You are expected to carefully read, understand, and agree to all provisions set forth in this Privacy Policy.


A. About Us

PT. BINAWAN INTI UTAMA is a limited liability company established under the laws of the Republic of Indonesia, having its domicile and principal office at Jl. Raya Kalibata No. 25–30, Cawang Village, Kramat Jati District, East Jakarta 13630. The Company was established pursuant to Deed of Establishment No. 106 dated February 10, 1989, drawn before M. S. Tadjoedin, Notary in Jakarta.

The Deed of Establishment has been adjusted to comply with Law Number 40 of 2007 concerning Limited Liability Companies, as reflected in Deed No. 02 dated August 1, 2008, which has been approved by the Ministry of Law and Human Rights of the Republic of Indonesia under Approval No. AHU-23831.AH.01.02 dated June 1, 2008. The Company’s articles of association have been amended several times, most recently by Deed of Statement of Meeting Resolutions No. 07 dated June 14, 2024, which has been approved by the Minister of Law and Human Rights of the Republic of Indonesia under Approval No. AHU-0036481.AH.01.02 of 2024 dated June 21, 2024.

We are a company engaged in the selection and placement of Indonesian Migrant Workers (hereinafter referred to as “PMI”), and have obtained the necessary business license under Business License No. 12340024214990003 issued by the Ministry of Manpower of the Republic of Indonesia on December 20, 2021.

B. Personal Data Subjects

We collect and process information and/or personal data from the following parties to support the implementation of our business activities and operations:

  1. Prospective Training Participants, Prospective Indonesian Migrant Workers, and/or Indonesian Migrant Workers;
  2. Prospective clients, business partners, and contacts of clients or partners who cooperate with Us;
  3. Contacts of suppliers, vendors, or service providers that support the Company’s operational activities; or
  4. Users of websites or digital platforms managed by Us.

All collection, use, storage, disclosure, protection, and processing of information and/or personal data shall be carried out in accordance with Law Number 27 of 2022 concerning Personal Data Protection and other applicable laws and regulations.


C. Type of Personal Data We Collect

The information and/or personal data (hereinafter referred to as “Personal Data”) that We may collect or process from the time You visit our platform and/or from other sources include, but are not limited to, the following:

1. Identity Data

  • Full Name;
  • National Identity Number (NIK);
  • Place and Date of Birth;
  • Gender;
  • Nationality;
  • Marital Status; and
  • Other identity-related data

2. Contact Information

  • Correspondence Address;

  • Other contact information.

3. Administrative Documents

  • Passport;
  • Diploma and Academic Transcript;
  • Family Card;
  • Birth Certificate;
  • Medical Check-Up Result;
  • Proof of Vaccination and Medical Records; and
  • Other administrative documents.

4. Employment and Professional Profile Data

  • Curriculum Vitae (CV);
  • Employment History or Work Experience;
  • Language Certificates, Skill Certificates or other professional certifications; and
  • Other employment and professional data.

5. User Data

  • IP Address;
  • Device ID;
  • Usage activities (including password, access time, and other related);

6. Other Data

  • Photographs;
  • Financial Information (if any);
  • Social Media information;
  • Promotional information; and
  • Other relevant information, to the extent permitted by the applicable laws and regulations.

D. Purpose and Legal Basis for Processing Personal Data

We will process Personal Data only based on explicit consent, compliance with legal obligations, and our legitimate interests, as stipulated under Law Number 27 of 2022 concerning Personal Data Protection.

Consent for the processing of Personal Data may be provided through:

  1. An Electronic Personal Data Processing Consent Form (hereinafter referred to as the “Consent Form”);
  2. Clicking an “agree,” “confirm,” or similar button on our platform; or
  3. A wet signature or electronic signature, where required.

The Personal Data that We process will be used for the following purposes:

  1. Implementation of recruitment and placement processes for Prospective Indonesian Migrant Workers, including but not limited to candidate selection, document verification, job placement administration, candidate database management, and communication with Prospective Indonesian Migrant Workers and Employers;
  2. Management of relationships with clients, business partners, vendors, and/or other third parties, including the execution of cooperation agreements, business communications, and service administration;
  3. Providing information regarding services, programs, or other offerings relevant to Your needs;
  4. Compliance with applicable laws and regulations, including but not limited to administrative obligations, reporting to government authorities, or disclosure of information to authorized authorities in accordance with applicable laws, regulations, or court orders;
  5. Preventing and addressing unlawful activities;
  6. Storing and managing information for our internal purposes, including but not limited to risk management, research, analysis, service development, and relevant marketing activities; and
  7. Other purposes necessary to serve our legitimate interests related to our business activities, operations, or business interests, provided that such purposes do not conflict with applicable laws and regulations.

E. Disclosure of Personal Data to Third Parties

We may disclose or share Your Personal Data with certain third parties where necessary for the purposes of Personal Data processing as described in this Privacy Policy and in accordance with applicable laws and regulations.

Where We disclose Your Personal Data to third parties, we will ensure that such third parties implement personal data protection and security standards equivalent to those applied by Us, including through the implementation of confidentiality obligations, personal data protection and processing agreements, or other protection mechanisms required under applicable laws and regulations.

  1. Employers or Prospective Employers, including companies or organizations that cooperate with Us in the recruitment, selection, and job placement processes;
  2. Business partners, clients, or affiliates that cooperate with Us in the provision of services, training programs, human resource development, or other business activities;
  3. Vendors or service providers, including but not limited to information technology service providers, system administrators, digital platform operators, or other service providers that support our operational activities;
  4. Government agencies, authorities, or regulatory bodies, where disclosure is required under applicable laws and regulations;
  5. Affiliates or companies within the same corporate group as Us, where necessary to support operational, administrative, and legitimate business purposes; or
  6. Other parties legally permitted under applicable laws and regulations, or parties who receive Your consent as the Personal Data Subject.

Any disclosure of Personal Data will be carried out only to the extent necessary and limited to relevant data, while maintaining the confidentiality and security of Personal Data in accordance with applicable laws and regulations.


F. Storage and Retention of Personal Data

We will retain Your Personal Data for as long as necessary to fulfill the purposes of Personal Data processing as described in this Privacy Policy, including for the purpose of complying with legal obligations, applicable laws and regulations, dispute resolution, or our other legitimate interests.

The retention period for Personal Data will be maintained for the duration necessary to achieve the purposes of processing and for as long as permitted under applicable laws and regulations.

Upon the expiration of the applicable retention period, or when the Personal Data is no longer required for the purposes of processing, we will delete and/or securely destroy such Personal Data in accordance with our internal policies and applicable laws and regulations.

We will also implement reasonable and appropriate technical and organizational measures to safeguard Personal Data during the storage process, including protection against unauthorized access, unlawful use, alteration, disclosure, or destruction of Personal Data, in accordance with our internal policies and applicable laws and regulations.


G. Right of the Personal Data Subject

During the period in which We process Your Personal Data, we are committed to respecting and ensuring Your rights as the owner of the Personal Data, including the following:

  1. The right to obtain information or notification as to whether Your Personal Data is being processed or has been processed;
  2. The right to access and obtain a copy of Your Personal Data;
  3. The right to update, correct, or complete Your Personal Data;
  4. The right to object to any inaccuracies or errors in Your Personal Data;
  5. The right to rectify Your Personal Data, provided that such rectification does not conflict with applicable laws and regulations;
  6. The right to delay, withdraw, or restrict the processing of Your Personal Data, as well as to request the deletion or destruction of Your Personal Data; and
  7. The right to lodge a complaint with the relevant government authority regarding any violation of personal data privacy committed by any party involved in the processing of Personal Data under this Agreement.

H. Data Breach

In the event of a Personal Data breach, including but not limited to unauthorized access, disclosure, alteration, loss, or destruction of Personal Data that may affect the confidentiality, integrity, or availability of Personal Data, we will take necessary measures to investigate and mitigate the impact of such incident.

Where a Personal Data breach may result in risks to the rights and interests of the Personal Data Subject, we will notify the affected Personal Data Subject and the relevant authorities in accordance with applicable laws and regulations.

Such notification will include, at minimum:

  1. Information regarding the Personal Data that has been compromised;
  2. The circumstances and cause of the Personal Data breach (to the extent known);
  3. The potential impact of the breach; and
  4. The measures taken by Us to address and mitigate the breach.

The notification will be provided within the period required by applicable laws and regulations, including the timeframe stipulated under the laws of the Republic of Indonesia.

We will also take appropriate corrective actions to prevent similar incidents from occurring in the future.


I. International Transfer of Personal Data

Your Personal Data may be transferred to, stored, or processed in countries outside the territory of the Republic of Indonesia, including but not limited to countries where prospective employers, business partners, or service providers are located.

In the event that such cross-border transfer of Personal Data occurs, We will ensure that the transfer is carried out in accordance with applicable laws and regulations, including ensuring that the receiving party provides an adequate level of Personal Data protection equivalent to the protection standards required under the laws of the Republic of Indonesia.

Where required by applicable laws and regulations, we will obtain Your consent prior to transferring Your Personal Data outside the territory of the Republic of Indonesia.


J. Personal Data Security

We are committed to maintaining the confidentiality and security of Your Personal Data. To protect Personal Data from unauthorized access, disclosure, alteration, misuse, or destruction, we implement appropriate administrative, technical, and physical security measures.

Such security measures may include, but are not limited to:

  1. Access control and authorization mechanisms for internal personnel;

We do not intentionally collect or process Personal Data of individuals under the age permitted by applicable laws without the consent of their parent or legal guardian.

Where the processing of Personal Data involves minors, such processing shall only be conducted with the consent and supervision of the parent or legal guardian in accordance with applicable laws and regulations.


M. Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of the Republic of Indonesia.

O. Dispute Resolution

In the event of any dispute, disagreement, claim, or controversy arising out of or in connection with the implementation of this Privacy Policy and/or the processing of Personal Data, the Parties shall first attempt to resolve such dispute amicably through mutual consultation and the internal dispute resolution mechanism provided by Us.

If the dispute, disagreement, claim, or controversy related to the implementation of this Privacy Policy and/or the processing of Personal Data cannot be resolved through mutual consultation, the Parties agree that such dispute shall be resolved through the East Jakarta District Court, in accordance with the laws of the Republic of Indonesia.
